Public Offer Agreement

General provisions

1.1. This offer is an official offer of the Company "Kordelia", hereinafter referred to as the "Lessor", to conclude a Lease Agreement for goods remotely, that is, through the website, hereinafter referred to as the "Contract", and places a Public Offer (offer) on the official website of the Lessor https://www.kordelia.kiev.ua / (hereinafter - "website").

1.2. The moment of full and unconditional acceptance by the Lessee of the Lessor's offer to conclude an electronic goods lease agreement is considered to be the fact of placing an order by the Lessee under the terms of this Agreement, on time and at prices agreed with the Lessor's representative.

Concepts and definitions

2.1. In this offer, unless the context requires otherwise, the following terms have the following meanings:

* "product" - models, accessories, accessories and accompanying items;

* "website" - a set of information, access to which is provided via the Internet by domain name;

* "Online store" - in accordance with the Law of Ukraine "on Electronic Commerce", a means for presenting or selling goods, work or services by making an electronic transaction;

* "Lessor" - a company that sells products presented on the website;

* "Lessee" - an individual or a company that has concluded a Contract with the Lessor on the terms set out below; * "Order" - the selection of individual items from the list of goods specified by the Lessee when placing an order and making payment.

Subject of the Contract

3.1. The Lessor undertakes to transfer the Goods to the Lessee, and the Lessee undertakes to pay the rent and accept the Goods under the terms of this Agreement. This Agreement regulates the lease, purchase and sale of goods in the Online store, including: - voluntary selection of goods by the Tenant in the Online store; - independent execution by the Tenant of the order in the Online store; - payment by the Tenant of the order issued in the Online store; - processing and delivery of the order to the Lessee under the terms of this Agreement.

Order processing procedure

4.1. The Lessee has the right to place an order for any product presented on the website of the Online Store and available.

4.2. Each item can be presented in the order in any quantity.

4.3. In the absence of the goods, the Manager of the company must inform the Tenant (by phone, via messenger or via e-mail).

Order payment procedure

Cash payment

5.1. Payment is made upon receipt of the goods from an employee of the company for cash in UAH.

Order delivery terms

6.1. Delivery of goods ordered in the Online store is carried out by means of the company or by means of the Lessee (pickup).

Rights and obligations of the parties:

7.1. The Lessor has the right to: - unilaterally suspend the provision of services under this agreement in case of violation by the Lessee of the terms of this agreement.

7.2. The Lessee is obliged to: - timely pay for the order received under the terms of this agreement.

7.3. The Lessee has the right to: - place an order in the Online store;

Responsibility of the parties

8.1. The Parties are responsible for non-fulfillment or improper fulfillment of the terms of this agreement in accordance with the procedure provided for by this agreement and the current legislation of Ukraine.

8.2. The Lessor is not responsible for: - for a slight discrepancy in the color scheme of the goods, which may be caused by a difference in perception or color transmission of monitors; - for the content and truthfulness of the information provided by the Lessee when placing an order; - for delays and interruptions in the provision of Services (order processing and delivery of goods), which occur for reasons- for illegal illegal actions carried out by the Tenant using this access to the Internet; - for illegal illegal actions carried out by the Tenant using this access to the Internet; - for the transfer by the Tenant of their network identifiers - IP, MAC address, login and password to third parties;

8.3. The Lessee, using the Internet access provided to him, is independently liable for damage caused by his actions (personally, even if another person was under his login) to persons or their property, legal entities, the state or moral principles of morality.

8.4. In case of force majeure, the parties are released from fulfilling the terms of this agreement. Force majeure circumstances for the purposes of this agreement are understood to be events of an extraordinary, unforeseen nature that exclude or objectively interfere with the performance of this agreement, the occurrence of which the Parties could not foresee and prevent by reasonable means.

8.5. The Parties shall make every effort to resolve any disagreements exclusively through negotiations.

Other conditions

9.1. The online store reserves the right to unilaterally amend this agreement, subject to its preliminary publication on the website kordelia.kiev.ua .

9.2. The online store was created to organize a remote way of selling goods via the Internet.

9.3. The Lessee is responsible for the accuracy of the information specified when placing the order. At the same time, when carrying out the lease, the Lessee provides the Lessor with his unconditional consent to the collection, processing, storage, use of his personal data, as understood by the Law "On Personal Data Protection".

9.4. Payment by the Lessee of an order placed in the Online Store means the Lessee's full agreement with the terms of the lease, purchase and sale agreement (public offer).

9.5. The actual date of the electronic agreement between the parties is the date of acceptance of the terms, in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce".

9.6. The use of the Online store for previewing the goods, as well as for placing an order, is free for the Tenant.

10.1. An electronic contract is considered concluded from the moment the person who sent the offer to conclude such an agreement receives a response on acceptance of this offer in accordance with the procedure defined by part six of Article 11 of the Law of Ukraine "On Electronic Commerce".

10.2. This Agreement may be terminated by mutual consent of the parties before the expiration of the validity period.

10.3. The parties have the right to terminate this agreement unilaterally, in case one of the parties fails to fulfill the terms of this Agreement and in cases provided for by the current legislation of Ukraine.
